Terms of Use
1. Agreement
These Terms govern your use of modern-leverage.com and the free Modern Leverage AI Check (the “Check”). By using the Check you confirm that you agree to them. Our Privacy Policy explains how we handle personal information. If you do not agree, please do not use the Check.
2. Who may use the Check
You must be at least 18 years old and using the Check for a business. If you answer for a business, you confirm that you are allowed to do so.
3. What the Check is, and what it is not
- What it is: a free, multiple-choice self-assessment. It places your business on each area it covers, never as a single score.
- General information only: your result is general information produced by fixed rules from your answers.
- Not professional advice: it is not legal, financial, tax, accounting, technical, security or other professional advice.
- Not a proposal: it is not a proposal, an estimate, or an offer of services.
- No client relationship: using the Check does not make you a client of Modern Leverage LLC.
- No confidentiality: using the Check creates no confidentiality obligation. Do not enter confidential information.
- Your decisions: any decision you make based on your result is yours.
4. Your answers
- Ownership: you keep ownership of your answers.
- What you allow us to do: you give Modern Leverage LLC a non-exclusive right to use your answers to produce and show your result, to send you what you ask for, and to create totals that cannot identify you or your business, which we use to improve the Check.
- What we will not do: we do not sell your answers. No AI tool reads them.
- Deletion: we delete your answers as our Privacy Policy describes.
- Accuracy: you confirm that your answers are your own and that you are allowed to share them.
5. Our content
- What we own: the website and the Check belong to Modern Leverage LLC and are protected by copyright and other laws. That includes the questions, the result format, the text, the design, and the scoring that sits behind the Check.
- Your use: you may use your result for your own internal business purposes, and you may share it within your business.
You may not:
- copy, scrape or republish the questions or the Check;
- submit answers by automated means, or try to get around our bot protection;
- try to work out, reverse-engineer or extract the scoring behind the Check; or
- use the Check, its questions or its results to build or train a competing product or service.
6. Acceptable use
Do not use the site or the Check to break the law, to interfere with or overload the site, to probe or test its security without our written permission, or to submit anything harmful, unlawful, or that belongs to someone else without their permission.
7. Trademarks
Modern Leverage, our logos, and the names of our services marked ™ are trademarks of Modern Leverage LLC. Nothing in these Terms gives you any right to use them.
8. No warranty
THE WEBSITE AND THE CHECK ARE PROVIDED “AS IS” AND “AS AVAILABLE,” FREE OF CHARGE. TO THE FULLEST EXTENT THE LAW ALLOWS, MODERN LEVERAGE LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE CHECK WILL BE AVAILABLE, ERROR-FREE OR SUITED TO YOUR BUSINESS, OR THAT ANY RESULT WILL FOLLOW FROM ACTING ON IT.
9. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- MODERN LEVERAGE LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE WEBSITE OR THE CHECK; AND
- OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THEM IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).
Some laws do not allow these limits, and where they apply, these limits apply only as far as the law permits.
10. Changes and suspension
We may change these Terms by posting a new version with a new effective date. The version in effect when you used the Check applies to that use. We may change, suspend or end the Check at any time.
11. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute arising from them will be brought in the state or federal courts located in Cobb County, Georgia, and you and we consent to those courts.
12. General
- If any part of these Terms is found unenforceable, the rest stays in effect.
- If we do not enforce a term, that is not a waiver.
- These Terms and the Privacy Policy are the whole agreement about your use of the website and the Check.
- They do not govern any engagement. A signed agreement governs every engagement.
